OSHA's Emergency Response Standard would make 22 NFPA standards enforceable

OSHA's proposed Emergency Response Standard replaces the 1980 Fire Brigades rule, and it incorporates 22 NFPA standards by reference. Incorporation by reference is the part worth understanding: those consensus standards stop being best practice and become law for covered organizations.

The Department of Labor's July 2026 agenda projects a final rule in April 2027. Comment periods closed in July 2024 and January 2025, and an informal hearing ran that November and December.

OSHA's own position is that departments already following these standards largely comply already. That is the trap. Following a standard and being able to document that you followed it are different things, and only one of them survives an inspection. A department with current pump tests, hydro dates, gear inspections and training hours but no records to show for them is in the same position as a department that did none of it.

The volunteer service has argued the administrative burden is the real cost, not the safety requirements. That argument is about paperwork, which means the departments that get hurt in 2027 are the ones still keeping it on clipboards.

A large share of the 22 are recordkeeping and control standards, and several are already in CADReport as tracked requirements. Departments on the system can turn those on now and arrive at a final rule with years of documented history instead of a start date.

What you can start today
